General terms and conditions

§1 Validity towards entrepreneurs and definitions of terms

(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order. A consumer is any natural person who concludes a legal transaction for purposes that cannot predominantly be attributed to their commercial or independent professional activity (§ 13 BGB).


§2 Conclusion of a contract, storage of the contract text

(1) The following regulations regarding the conclusion of the contract apply to orders via our online shop http://www.armadillo-medtec.de.

(2) If the contract is concluded, the contract is concluded with armadillo GbR Beate Schumann & Cornelius Werner, Kleiner Stadtmarsch 9, 39114 Magdeburg.

(3) The presentation of the goods in our online shop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract. The offer is accepted in writing or in text form or by sending the ordered goods within one week. If the deadline has expired without result, the offer is considered rejected.

(4) When an order is received in our online shop, the following regulations apply: The consumer submits a binding contractual offer by successfully completing the ordering procedure provided in our online shop. The order takes place in the following steps:

1) Selection of the desired goods

2) Confirm by clicking the “Order” button

3) Checking the information in the shopping cart

4) Press the “checkout” button

5) Login to the online shop after registering and entering the registration information (email address and password, if applicable).

6) Re-checking or correcting the respective data entered.

7) Binding dispatch of the order by clicking the “order for a fee” or “buy” button

Before the order is bindingly sent, the consumer can go back to the website on which the customer's information is recorded and correct input errors by pressing the "Back" button in the Internet browser he is using and after checking his details Closing the internet browser will cancel the ordering process. We confirm receipt of the order immediately by an automatically generated email (confirmation of receipt). This does not constitute acceptance of the offer. (5) Storage of the contract text for orders via our online shop: We will send you the order data and our general terms and conditions by email. You can view the terms and conditions at any time at http://www.armadillo-medtec.de/agb.html. For security reasons, your order details are no longer accessible via the Internet.


§3 Prices, shipping costs, payment, due date

(1) The prices stated include statutory sales tax and other price components. In addition, there are any shipping costs.

(2) The consumer has the option of paying in advance, invoice, PayPal or credit card.

(3) If the consumer has chosen to pay in advance, he undertakes to pay the purchase price immediately after conclusion of the contract.


§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for immediate dispatch. Shipping takes place within 14 working days at the latest. In the case of payment in advance, the deadline for delivery to the shipping company begins on the day after the payment order to the bank responsible for the transfer and, for all other payment methods, on the day after the contract is concluded. If the deadline falls on a Saturday, Sunday or public holiday at the delivery location, the deadline ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the item sold, even in the case of a mail order purchase, only passes to the buyer when the item is handed over to the buyer.

(3) If the goods cannot be delivered to the buyer or if the goods are not picked up by the buyer at the shipping company's collection point and are subsequently sent back to us, we reserve the right to withdraw from the contract. In this case, the purchase price will be refunded less any shipping costs and return transport costs.


§5 Retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

A consumer is any natural person who concludes a legal transaction for purposes that cannot primarily be attributed to their commercial or independent professional activity. Right of withdrawal You have the right to withdraw from this contract within fourteen days without giving any reasons. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. Consequences of revocation

If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for any additional costs arising from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired. You bear the direct costs of returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functionality of the goods.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply to contracts

  • for the supply of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
  • for the delivery of goods that can spoil quickly or whose expiry date would quickly be exceeded;
  • for the delivery of alcoholic beverages, the price of which was agreed upon conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;
  • for the delivery of newspapers, magazines or magazines with the exception of subscription contracts.

The right of withdrawal expires prematurely for contracts

  • for the delivery of sealed goods which are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery;
  • for the delivery of goods if, due to their nature, they were inseparably mixed with other goods after delivery;
  • to deliver audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
